Fulmer says he didn't receive subpoena in Alabama

HOOVER, Ala. - A Jackson County (Ala.) court issued a subpoena Wednesday for Tennessee football coach Phillip Fulmer, however, Fulmer denied being served the document here Thursday morning.
News of the subpoena, which seeks Fulmer for a deposition in a defamation suit brought by Chattanooga car salesman Wendell Smith against the NCAA, began to circulate – along with photocopies of the subpoena – about 11 a.m. Thursday during SEC Media Days at the Wynfrey Hotel.
Chris Linton, a clerk at the Birmingham law firm of Blankenship, Harrelson and Wollitz representing Wendell Smith, told the News Sentinel that a process server gave Fulmer the subpoena as Fulmer exited an SUV in front of the hotel before his appearance here Thursday.
Fulmer, however, said he was unaware of any subpoena and that he had not been served.
“A couple guys have asked me about that, and I haven’t seen anything like that,” Fulmer said. “We spent, what was it three or four years ago, putting up with all that BS that had nothing to do with football and the Southeastern Conference. And darn if I’m going start it again if I don’t have to.
“Somebody’s just screwing around, it just sounds to me like.”
Fulmer echoed those same comments throughout the morning and early afternoon as he met with various media groups.
The subpoena was issued Wednesday, and Jackson County Circuit Court judge John Graham granted a motion to waive the usual 15-day period from issuing a subpoena before it can be issued, the Jackson County clerk’s office said.
The subpoena calls for Fulmer to be deposed Sept. 25 in Birmingham, two days before the Vols play at Auburn, however that date would likely be postponed assuming Fulmer could show the timing of the deposition is “unreasonable.”
It also remains unclear whether Fulmer will actually wind up testifying in the case.
Smith has a long standing suit against the NCAA, claiming the organization slandered him in accusing him of violating NCAA rules. Smith was accused of providing football player Kenny Smith, no relation, with $20,000 to play football at Alabama in the late 1990s. Smith had questioned Fulmer's role as a source in the NCAA's investigation.
Fulmer's attorney Jeff Hagood, reached in Knoxville early this afternoon, said Fulmer had not called him about the matter.
"We talked last night and early this morning, but it was mainly about his new grandson," Hagood said.
Fulmer became a grandfather Monday when his daughter, Courtney Peace, gave birth to Joseph Phillip Peace in Austin, Texas.

This subpoena is about food. Chavis and Fulmer ate the whole buffet at the Bama Cafeteria - leaving nothing but crumbs for other patrons. As a result, the place had to close down 4 hours early!

This is just another reason UT needs to lobby the SEC to move its media days from Alabama. It is a state that is using its judicial system to try to settle an old score for its football team. Hamilton needs to lobby that all SEC events be moved from Alabama. Since Alabama seems unphased by its NCAA violations and law breaking ways, it may be time to vote them out of the SEC. They are cheaters and thank goodness our coach stood up to them. Maybe UT needs to pull a Pat Summitt and permanently remove them from our schedule.

The SEC should never have their yearly pre-season football Media days in any state with the backward reputation of the past and present as Alabama. Just wonder how Fulmer and his attorneys will handle this for it could be a distraction within the football season.

Alabama is going to get what's coming to them this fall! I hope they get the death penalty. They deserve that too. NCAA should go right in and clean house after this stuff. I can't believe they think they can sue the ncaa and then think they can find favor in the long run. I hope they slap them with so many sanctions when they get caught again that it will bury them for years! It's going to happen. You can't think the ncaa will ever forget this.

Fulmer is only giving a deposition as a witness. That is not legal trouble (dcflorida?). The timing is the issue. It is meant to disrupt Fulmer. Give the nasty details now while the media is watching, and let bama relive the embarrassment of getting caught by the NCAA and in a federal criminal court

That would be nice if it were possible. Unfortunately, the SEC creates the in-conference schedule themselves so Tennessee can do nothing about it.

gator do you understand a subpoena for a deposition only means he must show up at a certain time and place to answer questions? That is if the subpoena stands. I think more likely than not there will be no deposition on Sept. 25 of Fulmer. Regardless, he is not a party. Hence, no judgment can be ordered against Fulmer.

I think this makes Bama look just as bad as Phil...it is dragging out something that they thought was over and done with. They had a fairly clean start with the new coach. Now Saban will get asked about it and be a distraction to him as well.
I think this will be another reason for the "disrespected" Vols to come out strong this season.

I do not think this will hinder Fulmer's recruiting efforts in forty-nine states. It is very possible Alabama is trying to hurt Phil's recruiting in Alabama this year(and I think we do have some solid prospects there?) in addition to throwing a wrench into media days. IF(always an outside chance this has nothing to to with anything previously discussed) indeed this is related to football...In my opinion, the feds need to step-in and remove any judges from the bench who are letting this happen during this time frame. It certainly appears this is a good 'ol boy judicial system in Alabama. For any recruit, I'd suggest looking up Governor Wallace(Alabama). This certainly smacks of the good 'ol days in Alabama when the governor refused to accept wrong doing.

If I'm a UT recruiter, I use this to point how petty and vindictive Bama is. I would point out that they violated the rules and several coaches including Spurrier provided information. That they were caught giving recruits money... and that since they got caught they were trying to get revenge.
If played right, this will blow up in Bama's face badly. I would almost wager that Saban and people close to the program just want this to go away.

I'm saddened that you don't realize you are throwing stones all the time at our coach and evidently fail to see that as 'what goes around comes around.' My understanding is that this suit was not brought against the NCAA by Bama but by Wendell Smith, a Bama booster. Some, really UA had no say in whether this subpoena was issued or not. And the only way this whole case was not thrown out is by filing suit in Alabama. As a citizen of Tennessee, Smith had the option of filing at home, but Tennessee judges are too intelligent to allow this type of frivilous lawsuit occur in their state.

Alabama has been buying players for a long time in Memphis. It was a joke on local radio every football season as to why the NCAA couldn't figure it out. Info on Means, Lang, Logan Young was out in the community years before it hit the courts and Alabama severed ties with Young.

This is nothing. It is just a subpoena for Fulmer to come testify. Fulmer's not on trial and it is Bama that was in the wrong. I hope Fulmer's testimony somehow ruins the guy's libel and defamation suit and he ends up with nothing but a huge legal bill. I agree with the earlier posters in that this makes Bama look bad by bringing their cheating days back into the spotlight. I bet the Bammer Athletic Dept is not too crazy about Wendell bringing this lawsuit to court.
The big question is how do you come up with an unbiased jury for the case? I'm sure every dumb_ss Bammer redneck with nothing better to do on a weekday then sit in court has been a lifelong fan of either Bama or Auburn and there's no way that they will be able to view the case objectively. It may end in a hung jury or a mistrial.
Maybe we'll get some good locker room material out of it or maybe it'll just go away.

It is interesting that Fulmer continues to deny he received a subpoena. Has anyone confirmed that the Jackson Co. Circuit Court actually issued this and that this isn't some hoax to smear UT during SEC media days? Nonetheless, the fact this still hangs over UT every media days means that Alabama should(I say again) be eliminated as a venue for SEC media days. It's time the conference police itself.

Almost all Gator fans were as happy when Zook was fired as they were "shocked" the day he was hired. We went from hearing it might be Shanahan or Bobby Stoops to getting Zook. Zook was great when no one gave his team a chance, but pretty average at best, when he was the equal or favorite to win. I hear that a lot from "some other fans" about their coach ;-)

Tennesse Florida has decided the SEC East way more than any other game in the past fifteen years so it undeniable that we have to be in the top two. of course inner state rivalries are a different animal and that game could be between two winless teams and still sellout.

but ZOOK coached 3 years. It was mostly his players that won the title in 06 Leak mainly, You will never now if he was average at best because he was never given the full oppurtunity. He had no QB when he came in and yet was as successful as spurrier has been in SC his first few years. His recruits proved to be phenomenal. and whether he was a good coach or not (in the SEC) will never be determined now.

as several have said, this case does not involve the university of alabama directly, but a booster from several years back who is now suing the ncaa.
as far as the subpoena, the court doesn't issue a subpoena, the law firm representing smith did.

Phillip Fulmer is from my home county and went to the same high school that I went to. That family is above reproach and are if impeckable integrety. If Tennessee was getting all of the recruits out of Montgomery that Alabam wanted they would have done the same thing that Phillip did. The problem is the "red neck attys." in Alabama that think they can stop chasing ambulances if they get service on CPF and force him to AL. to testify. chrslyp...I would assume(though the court didn't issue the subpoena...as you state) that Wendel Smith is filing in the Alabama Judicial System(Jackson Co. Court according to this article). Assuming the issuing of the subpoena is true, the Alabama Judicial System will be hearing this frivolous case. So yes. the Alabama Judicial System would still be involved. Thus, it is corruption IMO of the judicial establishment if this is actually occuring. As far as Wendell Smith being "loosely tied" to Alabama...Riiiiight! I am not poking fun at you, chrslyp - just at the person originally making the comment. I don't think the University of Alabama would make it obvious who is doing "the deed" for them. They know how to cover their tracks.

Here is what ESPN has to say. After reading this, here are my thoughts...
1. Where was the security in Alabama? How do you let someone "stake out" your media days and target a coach? What if the "stake out" folks had been terrorists?
2. If I was UT, I would tell the league to put the Auburn game at a neutral site(outside of Alabama) for the next two years. Otherwise, UT should not play the game. UT should take Bama to the brink(publicity wise) and let them look into the abyss of public shame. Auburn fans I am NOT pointing the finger at you. The Alabama rivalry should be discontinued as Summit did w/ UConn.
3. The SEC must leave Alabama and go to another state for all official meetings and tournaments.
4. IF Smith is still connected to the University of Alabama in any way(i.e. phone calls, e-mails, couriers, etc), they should be kicked out of NCAA football or at least the SEC.
5. Hamilton should ask the University of Alabama to publicly denounce the proceedings that apparently(or not) happened today as frivolous.
